Personnel Security Guidelines

The following guidelines are provided to FEMA contractors for use during review of FBI fingerprint results. These guidelines were developed to help expedite the hiring process without compromising sound hiring procedures. Listed below are the criteria for an applicant's immediate disqualification for Federal employment or referral for formal HQ Personnel Security adjudication.

The use of these guidelines is intended to help protect FEMA staff, other disaster workers, and disaster victims from unnecessary exposure to persons with a criminal background.

FBI Findings

1) Failure to register for the Selective Service System. Refer to HQ Security

2) Criminal conviction, imprisonment, probation, or parole during the last ten years.
  • Felony arrest & conviction - Disqualified. Over ten years ago requires HQ adjudicative review.
  • Felony arrest without disposition - Disqualified, unless FBI record clearly reports no conviction. Otherwise the applicant must prove to HQ Personnel Security they were not convicted. Evident of no conviction eliminates the issue.
  • Crime of Violence (Felony or Misdemeanor) - Disqualified, unless FBI record clearly reports no conviction. A conviction requires HQ adjudicative review.
  • Possession and/ or Use of Illegal Drugs - Disqualified, unless FBI record clearly reports no conviction.
  • Manufacture, Sale, or Transportation of illegal drugs - Disqualified, unless FBI record clearly reports no conviction and no other drug related charges in past ten years.
  • Alcohol arrests and convictions including driving offense; one in last three years, or more than one in past ten years.
  • Sexual Offenses - Disqualified, unless FBI record clearly reports no conviction and there are no other sexual related charges in past ten years.
  • Arrest for Arson. Explosive or Firearms Violations - Disqualified, unless FBI clearly reports no conviction and no related charges in past ten years. Two or more arrests in ten years requires HQ Security review.
  • Any applicant currently on parole (felony offense) is disqualified.
  • Any arrest and/or conviction that brings into question the applicant's moral character, work ethics, or allegiance to the United States referred to HQ Security.
3) Military Court Martial Conviction.
  • Convictions in Military courts results in same action as civilian courts.
  • Any UCMJ conviction resulting in imprisonment, a discharge less than honorable, or reduction in rank, will be referred to HQ Security.
